- Vi anmälde intrånget i juli 2009, men gick inte ut med det då. Ärendet öppnades igen 22 januari i år. Det har varit ett stopp under hösten, men vi har varit öppna för förhandling hela tiden. Det är först nu discoveryfasen inleds. Nu kommer det att vara en väldigt arbetskrävande fas under ungefär sex månader. Det är mycket information ska fram från båda sidor.
Hur upptäckte ni det misstänkta intrånget?
- Företaget visar på sin sajt att de använder det som vi anser är vår teknik.
Har Fluxion varit villiga att diskutera?
- Vi har haft kontakt tidigare och är öppna för att diskutera med dem.
Vilken är er strategi?
- Det är ju att driva processen vidare. Vi har ett ansvar gentemot våra investerare och det är vår ståndpunkt att de gör patentintrång. Vi behöver försvara värdet i bolaget - patenten rörande tekniken i Dynaflowplattformen är en viktig del i vår verksamhet.
Du har sagt att ni kommer att ta "alla nödvändiga steg" för att försvara ert patent - vilka scenarier ser du?
- Allt ifrån att processen fortsätter - det kan ta två, tre år - till att vi hittar någon lösning på vägen. Vad det skulle kunna vara för lösning vill jag inte gå in på.
Vad är det värsta som kan hända?
- Jag ser inte vad det skulle kunna vara. Vi har undersökt det här noga under en tid och vår ståndpunkt är att de gör intrång.
Driver ni processen tillsammans med Gyros, som äger ett av patenten och som ni har licens på?
- Vi driver den själv rent praktiskt, men de är delaktiga eftersom de äger det fjärde patentet.
Hur lång tid räknar ni med att processen kommer att ta?
- Från 2009 juli har jag fått information om att det tar ungefär 2-3 år.
Hur stora investeringar har ni gjort kring tvisten?
- Jag vill inte kommentera exakta siffror. De eventuella pengar det här kostar tjänar vi in på att driva processen. Jag ser det inte som en kostnad.
Hur lång tid tar det innan det betalar sig?
- Det beror på utgången. Om vi fortsätter processen borde det vara relativt kort tid.
Hur stora konkurrenter är Fluxion?
- Vi agerar delvis på samma marknad och det finns ett överlapp för våra produkter.
